Legal Battle Continues: Kilmar Abrego Garcia's Team Fights for Sanctions Against Trump Administration

Kilmar Abrego Garcia's legal team is fighting to keep a civil case against the Trump administration active to pursue sanctions against officials for defying orders to bring him back from El Salvador, where he was mistakenly deported earlier this year. Despite the government returning Abrego Garcia to the US to face federal criminal charges in Tennessee, Justice Department lawyers are requesting a halt to all deadlines in the civil case, claiming that his return has made the case irrelevant. However, just before his return, US District Judge Paula Xinis had granted permission for Abrego Garcia's attorneys to seek sanctions in the case and instructed them to file a formal request by June 11.
The civil case in Maryland was initiated by Abrego Garcia and his family in March to secure his return to the US. His lawyers accused the executive branch of defying court orders and acting in contempt towards the judiciary. They emphasized that the government had the means to bring Abrego Garcia back but deliberately delayed his return to avoid facing contempt sanctions. The attorneys disputed the government's claim that they facilitated his return for immigration proceedings, pointing out that he was taken to Tennessee to face criminal charges, not Maryland.
Abrego Garcia is facing federal charges related to conspiracy and unlawful transportation of illegal aliens for financial gain, which were filed in May and unsealed upon his return to the US. His legal team argued that the court still has a role in ensuring that his case is handled appropriately, especially considering the government's ongoing threat of removal. They maintained that the case remains active to address Abrego Garcia's status following the resolution of his criminal charges and emphasized the court's jurisdiction to find contempt and impose sanctions.
In mid-March, the government deported Abrego Garcia to El Salvador, violating a court order from 2019 that prohibited his removal due to concerns about gang violence in the country. Despite his return to the US, the legal battle continues as his attorneys seek accountability for the actions of government officials in the deportation case.
