Lively, 37, testified in a deposition in New York City on July 31, and her lawyers requested to strike a 292-page rough draft of the transcript from the public record, which the judge granted on August 8. The judge criticized Baldoni's team for uploading the deposition transcript to the public docket without a valid legal reason, calling it a burden on Lively and the court.

Lively's lawyers accused Baldoni's team of leaking details about the deposition to media outlets to create a narrative of a dramatic confrontation between the two stars. Baldoni's attorneys questioned Lively's motive for wanting to conceal her testimony as the plaintiff in the case. Lively's spokesperson expressed satisfaction with the deposition outcome and looks forward to deposing Baldoni and the co-defendants soon.

The conflict between Lively and Baldoni began with a sexual harassment complaint filed by Lively against Baldoni in December, alleging misconduct on the set and a smear campaign, which Baldoni denies. Judge Liman dismissed Baldoni's $400 million countersuit against Lively and her husband Ryan Reynolds in June. Both parties are expected to testify during the trial scheduled for March 2026 in New York.
