Judge Christopher A. Boyko stated that the exhibition of Neil Zlozower's images in the "Play It Loud: Instruments of Rock & Roll" exhibit was transformative and added new meaning, despite the close resemblance to the original images.
Neil Zlozower filed a lawsuit against the museum in the US District Court for the Northern District of Ohio, alleging copyright infringement in the use of his photographs. However, Judge Boyko's ruling emphasized that the museum's use of the images was considered fair use, even though the copies were nearly identical.
