Hernandez alleged that Ziering used his celebrity status to falsely portray himself as the victim, leading to Hernandez's arrest and incarceration, as well as lasting emotional and physical harm.
The incident occurred when Hernandez was riding a mini-motorbike and got stuck between two cars due to traffic congestion. Ziering reportedly exited his vehicle without provocation and forcefully pushed Hernandez twice, causing him to fall onto the pavement. The altercation escalated into a brawl captured on video.
The Los Angeles Police Department's Hollywood and Metropolitan divisions later arrested two individuals in connection with the assault on Ziering. The confrontation began over possible damage to Ziering's vehicle, with multiple minibike riders allegedly assaulting him. Video footage showed Ziering's car surrounded by bikers before he engaged in a physical altercation with one of them.
Hernandez and Angie Teresa Guizar were identified as the suspects in custody, with Hernandez facing felony vandalism charges and Guizar charged with assault with a deadly weapon. However, the charges against Hernandez were eventually dropped.
In his complaint, Hernandez accused Ziering of lying to law enforcement and the media to avoid responsibility for the incident, resulting in his wrongful arrest and incarceration. Ziering allegedly used his celebrity status to manipulate the narrative and portray himself as the victim, omitting his role in the altercation.
