Another legal challenge was filed by the Gateway Development Commission, a local panel overseeing the project, to address the funding suspension issue. The construction project involves building a new rail tunnel under the Hudson River to accommodate Amtrak and local transit trains, as well as repairing an existing tunnel damaged during Superstorm Sandy in 2012.

Construction on the project began in 2023 and is funded by the 2021 federal infrastructure law signed by President Joe Biden. The legal actions taken by New York, New Jersey, and the Gateway Development Commission aim to ensure the continuation of this critical infrastructure project that is essential for the efficient transportation between the two states.
