Capitol Attack Plaintiffs File Lawsuit Against U.S. Capitol Police and D.C. Metropolitan Police in Florida

A group of individuals involved in the U.S. Capitol attack on Jan. 6, 2021, have filed a federal class action lawsuit in Florida against the U.S. Capitol Police and D.C. Metropolitan Police, claiming they suffered physical and emotional injuries due to the officers' actions that day. The lawsuit, filed by 46 plaintiffs seeking over $18 million in damages, alleges that police used explosive munitions, chemical agents, and impact projectiles against a peaceful crowd at the Capitol.

The lead plaintiffs in the lawsuit are Patrick and Marie Sullivan from Citrus County, and Alan E. Fischer III from Tampa. Fischer faced seven criminal charges for his actions on Jan. 6, including violent felonies. The Sullivans and Fischer were allegedly exposed to pepper spray and suffered injuries during the events at the U.S. Capitol.

One of the plaintiffs, Dominic Pezzola from New York, was sentenced to 10 years in prison for his involvement in the Capitol events. Another plaintiff, Craig Bingert from Allentown, Pa., was sentenced to 96 months in prison for pushing a metal bike rack against officers defending the Capitol. Christopher Worrell from Naples, another plaintiff, received a 120-month prison sentence for assaulting police officers with a dangerous weapon during the Capitol breach.

The lawsuit claims that the crowd at the Capitol was mostly peaceful before the police started using explosive munitions, affecting citizens exercising their First Amendment rights. Attorney Stephen Austin Carr from New Smyrna Beach is representing the plaintiffs in the case. The lawsuit was filed in the Ocala division of the U.S. District Court for the Middle District of Florida.
