Actress Q’orianka Kilcher Files Lawsuit Against James Cameron and Disney Over Unauthorized Use of Likeness in Avatar

Actress Q’orianka Kilcher has filed a lawsuit against James Cameron and The Walt Disney Company, alleging that her likeness was used without her consent. Kilcher claims that Cameron based the character of Neytiri in the movie Avatar on her facial features, which he noticed in her performance in the film The New World. The lawsuit references a YouTube video where Cameron discusses the inspiration behind Neytiri and acknowledges Kilcher's influence on the character's design.
Kilcher first met Cameron in 2010 at an environmental charity event, where he praised her activism work and gave her a sketch of Neytiri signed by him. The actress and her mother visited Cameron's office to receive the gift, which included a handwritten letter from the director expressing his admiration for her beauty and its influence on Neytiri's creation.
The lawsuit accuses Cameron of exploiting Kilcher's biometric identity and cultural heritage without giving her credit or compensation. Kilcher, a Native Peruvian actress and activist, was only 14 years old when Cameron allegedly used her facial likeness in the character design process for Avatar. The complaint seeks damages, disgorgement of profits, injunctive relief, and corrective public disclosure.
Kilcher's legal action aims to address the unauthorized use of her likeness in a major film franchise that generated significant profits. The lawsuit highlights the importance of protecting individuals' rights to their own image and seeks to hold filmmakers accountable for using others' identities without permission. Cameron and Disney have not responded to requests for comment on the matter.
