A new lawsuit has been filed against James Cameron and The Walt Disney Co. by Q’orianka Kilcher, who alleges that her likeness was used without her consent to create the character Neytiri in the movie Avatar. Kilcher claims that Cameron extracted her facial features from a photograph of her as Pocahontas when she was 14 years old and directed his design team to use it as the basis for Neytiri. The lawsuit accuses Cameron of exploiting Kilcher's biometric identity and cultural heritage for commercial gain without giving her credit or compensation.

According to the complaint, Cameron's production team created digital models of Kilcher's likeness to design Neytiri, which was then used on movie posters and merchandise without her knowledge or consent. The lawsuit also alleges that Cameron and his team concealed the inspiration behind Neytiri's character, despite using Kilcher's image as a foundation for the design. Kilcher, an actress and activist, claims she only found out about the unauthorized use of her likeness when she met Cameron in 2010 after Avatar's release.

Kilcher is seeking compensatory and punitive damages for the profits generated from the unauthorized use of her likeness. The lawsuit also claims that Cameron violated a deepfake pornography statute in California by using a photo of Kilcher as a minor to create an intimate character in the film. Kilcher expressed her disappointment and shock at the exploitation of her image without her knowledge or consent, stating that the act was deeply wrong and crossed a major line.
