Veterans Advocacy Group Challenges Trump Administration's Abortion Ban at VA: Lawsuit Highlights Impact on Pregnant Veterans' Health

A veterans advocacy group has filed a lawsuit against the Trump administration regarding the ban on abortion care and counseling at the Department of Veterans Affairs (VA). The Minority Veterans of America initiated the lawsuit on behalf of its members affected by the ban, including a pregnant member with chronic medical conditions who requires access to abortion care and counseling for her health. The lawsuit was filed in the U.S. Court of Appeals for the Federal Circuit, alleging that the Trump administration violated the Administrative Procedures Act by revoking a Biden-era legal opinion that permitted limited abortion counseling and services for pregnant veterans and their beneficiaries, particularly in cases of rape or incest.
The 2022 Biden administration policy allowed abortions for individuals who became pregnant due to rape or incest, or if the pregnancy posed a threat to their "life and health." Prior to 2022, the VA did not cover abortions. However, in December, the VA quietly reinstated the ban following a memo from Joshua Craddock, deputy assistant attorney general of the Department of Justice's Office of Legal Counsel, stating that the VA could not provide abortion services under any legal provision. This ban applies nationwide, irrespective of individual state abortion laws.
An anonymous service member represented in the lawsuit expressed fear and concern about her pregnancy, stating that the VA's ban on abortion care and counseling jeopardizes her health and ability to care for her existing children. The veteran, who had not planned to become pregnant and was advised by a doctor that she likely could not conceive naturally, is facing health complications exacerbated by her first-trimester pregnancy. There is a significant risk that she may need to terminate the pregnancy to safeguard her health.
The lawsuit argues that the VA failed to provide a sufficient explanation for disregarding previous findings on veterans' need for abortion care and failed to address significant comments. The National Women's Law Center and Democracy Forward are serving as co-counsel in the case. The veteran's statement highlights the personal impact of the VA's abortion ban on her health and family life. The lawsuit seeks to challenge the ban and ensure access to essential abortion care and counseling for veterans in need.
