Minnesota Legislature Reviews Bill on Home Care Nursing Services Coverage Caps

The Senate bill aimed at preventing health insurance companies from imposing coverage caps on home care nursing services did not advance out of conference committee during the final days of the Minnesota Legislature session. Instead, the committee directed the Department of Commerce to review the bill's language and provide a report to the Legislature, which was approved through a voice vote. The Conference Committee Report on House File 4188 was completed, and the committee adjourned.

A state law from 2010 mandates that health insurance companies must cover home care nursing services. However, earlier this year, HealthPartners and Medica started limiting the hours of coverage for patients with dual enrollment in private insurance and Medicaid. When the private insurance coverage cap is reached, the responsibility for the care cost shifts to Medicaid. Sen. Liz Boldon's bill sought to clarify the law's original intent and maintain the existing payment structure that has been in place for 16 years.

During a recent news conference, Sen. Boldon emphasized that the bill was not introducing a new coverage mandate but rather reinforcing the existing requirements for health insurance companies regarding home care nursing services. The decision to have the Department of Commerce review the bill's language indicates a potential reevaluation of the regulations surrounding coverage caps on home care nursing services by insurance providers.
