A recent court ruling in Tennessee has denied a woman's request for a restraining order against the controversial livestream personality known as Chud the Builder, whose real name is Dalton Eatherly. The court dismissed the petition filed by Yashmine Shauntea West, citing insufficient evidence to support the allegations of harassment and racially violent behavior made against Eatherly. West claimed that Eatherly had recorded their interaction at her workplace in Clarksville and posted it online, leading to ongoing harassment from his followers. The court found that West did not meet the criteria for a protective order and that the evidence presented did not meet the required threshold for a restraining order to be granted.

This development comes amidst Eatherly's legal troubles, as he is currently facing serious criminal charges related to a separate incident outside the Montgomery County Courthouse. Eatherly allegedly shot a man during an altercation, resulting in the victim being hospitalized with a gunshot wound to the stomach. Eatherly also sustained a gunshot wound to his arm and was subsequently arrested. In a livestream following the shooting, Eatherly claimed self-defense, stating that he was attacked and had to defend himself.

Prosecutors have charged Eatherly with attempted murder, aggravated assault, reckless endangerment with a deadly weapon, and employing a firearm during a dangerous felony. He is currently in custody on a $1.25 million bond. Prior to the courthouse shooting, Eatherly had been arrested in Nashville for an incident at a restaurant where he allegedly refused to pay the bill after being asked to stop livestreaming inside. He was charged with theft of services, disorderly conduct, and resisting arrest.
