USACE Issues Record of Decision for Dakota Access Pipeline Lake Oahe Crossing: Regulatory Certainty for Energy Infrastructure

The U.S. Army Corps of Engineers (USACE) has issued the Record of Decision (ROD) for the Dakota Access Pipeline (DAPL) Lake Oahe Crossing, allowing the pipeline to continue operating. Senator Kevin Cramer emphasized the need for permitting reform to prevent delays in infrastructure projects. Assistant Secretary Adam Telle highlighted the importance of regulatory decisions for the economy and energy sector. The USACE is committed to protecting the Missouri River and Lake Oahe while ensuring the pipeline's safe operation.

The ROD reauthorizes the pipeline's easement under Lake Oahe with additional monitoring and response measures. The National Environmental Policy Act (NEPA) requires federal agencies to assess environmental impacts, and the USACE conducted a comprehensive analysis for the DAPL crossing. The project faced delays and legal challenges during the Obama administration, leading to public safety issues and environmental damage. President Trump's administration granted the easement in 2017, and a full Environmental Impact Statement (EIS) was completed in December 2019.

The DAPL has been operational since 2017, delivering crude oil safely. Despite court-ordered environmental reviews, the pipeline has continued to operate. The ROD marks the completion of the EIS process, providing regulatory certainty for the project. The USACE's decision reflects a commitment to balancing economic needs with environmental protection. The completion of the Lake Oahe Crossing demonstrates progress in energy infrastructure development.
