Brian Flores' Racial Discrimination Lawsuit Against NFL: Supreme Court Declines Intervention
The Supreme Court has declined to intervene in a legal battle between the National Football League and Brian Flores, the defensive coordinator for the Minnesota Vikings. Flores, a prominent Black coach, has filed a racial discrimination lawsuit against the NFL and several teams, alleging that his race influenced decisions related to his coaching career. The lawsuit claims that Flores was fired as head coach of the Miami Dolphins in 2022 due to his race and that other teams, including the New York Giants and the Denver Broncos, did not hire him for the same reason.
Additionally, Flores alleges that the Houston Texans stopped considering him for a head coach position in response to his lawsuit, which has been supported by two other Black coaches. The NFL has contested these allegations, arguing that its rules require discrimination claims to be resolved by the NFL commissioner rather than through lawsuits. However, the 2nd U.S. Circuit Court of Appeals ruled against this argument in August, stating that the NFL commissioner lacks the necessary independence to arbitrate such disputes under the Federal Arbitration Act.
Despite the NFL's assertion that Flores' employment contract allows Commissioner Roger Goodell to address disputes or appoint an independent arbitrator, the appeals court determined that the league's arbitration provision was inadequate. The Supreme Court's decision not to review this ruling means that Flores' lawsuit can proceed. The NFL and the teams named in the lawsuit had urged the Supreme Court to consider the case, emphasizing the importance of upholding arbitration procedures and the choice of arbitrator in such disputes.
Flores' legal team maintained that the appeals court's decision aligns with previous rulings that prevent employers from compelling employees to resolve discrimination claims internally.
