Legal Battle Between Brian Flores and NFL Continues: Supreme Court Declines Intervention
The Supreme Court has declined to intervene in the legal battle between the National Football League and Brian Flores, the defensive coordinator for the Minnesota Vikings. Flores, a prominent Black coach, alleges that his race influenced the Miami Dolphins' decision to fire him as head coach and impacted his chances of being hired by the New York Giants and the Denver Broncos. He also claims that the Houston Texans retaliated against him for filing a discrimination lawsuit. Two other Black coaches have joined Flores in his lawsuit.
The NFL has refuted Flores' allegations and argued that the league's rules require discrimination claims to be resolved by the NFL commissioner, making it impossible for Flores to sue. However, the 2nd U.S. Circuit Court of Appeals rejected this argument in August, stating that the NFL commissioner lacks the necessary independence to arbitrate such disputes as mandated by the Federal Arbitration Act. The Supreme Court's decision not to review this ruling allows Flores' lawsuit to move forward.
Flores signed an employment contract that grants NFL commissioner Roger Goodell the authority to adjudicate disputes or appoint an independent arbitrator to oversee them. U.S. District Judge Valerie Caproni initially ruled that the league's arbitration clause only applied to Flores' claims against the Dolphins, but this decision was overturned following the appeals court's determination that the league's arbitration provision was inadequate. The NFL and the three teams named in the lawsuit argued to the Supreme Court that federal law protects the parties' right to arbitrate and their choice of arbitrator.
Flores' legal team countered that the appeals court's decision supporting his right to sue aligns with previous lower court rulings that prevent employers from compelling employees to address discrimination claims before the employer's chief executive. The ongoing legal battle highlights the complexities of addressing racial discrimination in professional sports and the challenges faced by minority coaches in the NFL.
