Hart claims that Shakes violated the NDA she signed during her employment by giving an interview about his personal life to blogger Tasha K. The comedian is seeking $50,000 in damages as stipulated in the NDA for any breach.
Hart's legal team asserts that Shakes agreed to keep details of his private life confidential as a condition of her employment, and the interview with Tasha K breached that agreement. The lawsuit also alleges reputational damage and defamation resulting from the interview, which contained information Shakes was prohibited from disclosing.
Prior to the interview's publication, Hart received a call demanding $250,000 to prevent its release. He refused the offer, reported it to the police as extortion, and sent a cease and desist letter to Tasha K. Despite these actions, the interview was published on Tasha K's platforms.
In a court declaration, Hart emphasized the professional consequences of a breach of confidentiality, citing his family entertainment projects and endorsement deals with national brands. He argued that public perception directly impacts his commercial partnerships, making a leak of private information detrimental to his business relationships.
Shakes has contested the enforceability of the NDA, claiming that Hart did not fulfill certain conditions outlined in the agreement, rendering it void. Hart's legal team is pushing for the court to uphold the contract and enforce the $50,000 penalty as specified.
