A screenwriter has initiated a legal action for copyright infringement against Illumination Entertainment and Universal Pictures, alleging that they copied elements from his screenplay, South for the Winter, for their film Migration. Kenneth Giavara filed a federal lawsuit against screenwriter Mike White, Illumination, and Universal, claiming that Migration plagiarized his 2007 screenplay. The complaint states that Migration replicated various aspects of South for the Winter, including plot, themes, characters, dialogue, and setting.

Giavara highlighted the similarities between the two stories, such as bird families in New England with overprotective fathers named Mac or Mack, and migration journeys featuring NYC’s Central Park. He argues that the significant overlap between the two works indicates that Migration could not have been created independently from South for the Winter. South for the Winter received recognition in screenplay competitions, and Giavara believes that White may have had access to his screenplay.

The lawsuit seeks damages, profits from the film, attorney’s fees, and a writing credit on Migration. Migration, released in 2023, starred Kumail Nanjiani, Elizabeth Banks, Keegan-Michael Key, Awkwafina, and Danny DeVito, and grossed over $300 million at the box office. White, the accused writer, is known for his work on HBO’s The White Lotus and has won three Emmys. He also wrote The Emoji Movie and co-wrote Despicable Me 4.
