California Couple Files Lawsuit Against Luxury Country Club Daycare Center Over Toddler's Traumatic Brain Injury

A California couple has filed a lawsuit against a luxury country club daycare center, alleging that their 23-month-old son suffered a traumatic brain injury due to the negligence of an employee. The incident occurred at The Clubhouse at Bay Club El Segundo, where the child was reportedly swung through the air, dropped, and not caught by the employee.

The lawsuit details the events of March 17, when the child was in the care of the daycare center. Surveillance video captured the moment the child was thrown into the air, resulting in a fall to the ground, followed by the employee falling on top of him.

The parents, Matthew Kittle and Elena Kittle, expressed their shock and concern over the incident, stating that the daycare center failed to provide proper care and supervision for their child. The lawsuit alleges that the staff downplayed the severity of the incident when informing the parents.

After the child was picked up by his father, Matthew Kittle, he was found to have sustained significant injuries, including a swollen eye, bruised face, and swollen mouth. The child exhibited symptoms of drowsiness, lethargy, and irritability after returning home.

Medical evaluation revealed that the child had suffered blunt head trauma, a concussion, and a facial abrasion as a result of the incident. The family sought answers from the daycare center and eventually obtained video footage that contradicted the center's incident report.

The family continues to seek justice through legal action, alleging negligence, emotional distress, and battery on the part of the daycare center. They are pursuing damages, punitive damages, and a jury trial to address the harm caused to their child.

The Bay Club has declined to comment on the ongoing litigation, emphasizing that the safety of their members and families is their top priority.
